Terms & Conditions (Crash BASIC)

Last updated: March 26, 2026

These Terms & Conditions (“Terms”) govern your access to and use of Crash BASIC and related services, including our websites, software, downloadable tools, and community features such as Crash BASIC Arcade (collectively, the “Services”). By accessing or using the Services, you agree to these Terms.

If you do not agree, do not use the Services.

1) Who We Are

Crash BASIC is operated by Crash Continuum LLC (“Crash BASIC,” “we,” “us,” “our”).

2) Eligibility and Age Requirements

2.1 Crash BASIC Arcade: 13+ Only

Crash BASIC Arcade is intended only for users aged 13 and older. You may not create an Arcade account or use Arcade features if you are under 13.

We do not knowingly collect personal information from children under 13 on Crash BASIC Arcade. If we learn that a user is under 13, we may terminate the account and delete associated personal information.

2.2 Crash BASIC (Local/Browser Tools)

Some Crash BASIC tools may run locally in your browser or on your device. However, if you use any online Services (accounts, Arcade uploads, billing, support, community features), these Terms apply.

2.3 Ratings and Audience

Crash BASIC Arcade includes experiences appropriate for an “E / Everyone” audience by default. Content above “E” may be restricted, require approvals/controls, or be rejected/removed at our discretion.

3) Accounts and Security

If you create an account, you agree to:

  • Provide accurate information and keep it up to date.
  • Maintain the security of your login credentials.
  • Be responsible for activity that occurs under your account.

We may suspend or terminate accounts for violations of these Terms.

4) Plans, Payments, Storage, and Feature Availability

Crash BASIC Arcade may offer multiple tiers. Current tiers are:

4.1 Free Tier

The Free tier includes:

  • Access to E-rated games available on Arcade
  • Ability to upload and share games on Arcade (subject to storage limits)
  • Access to the official Discord channel/community
  • Participation in official game jams and community events

Free tier projects are for non-commercial use only.

4.2 Indie Tier

Indie includes everything in Free, plus:

  • Additional storage for more media-rich content (subject to limits)
  • Ability to export games to native platforms, where available
  • Commercial use allowed for exported games
  • Removal of the “Not for commercial use” restriction
  • “Powered by Crash BASIC” splash screen remains required

4.3 Studio Tier

Studio includes everything in Indie, plus:

  • Higher storage limits (subject to fair use and technical constraints)
  • Full commercial flexibility
  • Option to remove or make optional the “Powered by Crash BASIC” splash screen

4.4 Billing and Renewals

If you purchase a paid plan:

  • Billing frequency and price are shown at checkout.
  • You authorize us (and our payment processor) to charge your payment method on a recurring basis until you cancel.
  • Plan features, limits, and availability may change over time.

4.5 Refunds

Unless required by law, purchases are generally non-refundable. If you believe there was a billing error, contact us and we’ll review it.

4.6 Storage and Limits

Storage is subject to:

  • Your plan’s storage allocation
  • Technical limits (file size caps, supported formats)
  • Abuse prevention (including automated or excessive uploads)

We may enforce reasonable limits to protect the Services and community.

4.7 Exports and Experimental Features

Exports to native platforms and experimental features:

  • May be unavailable in certain regions or on certain devices
  • May require additional steps, dependencies, or constraints
  • May change without notice while we iterate and improve the platform

5) License to Use Crash BASIC Software

Subject to your compliance with these Terms, Crash BASIC grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services and any Crash BASIC software you receive (including downloadable builds) for your personal or internal business use.

You may not:

  • Reverse engineer, decompile, or disassemble the Services except where the law explicitly allows it.
  • Remove or alter proprietary notices.
  • Use the Services to create or distribute prohibited content (see Section 7).
  • Use the Services to infringe intellectual property rights or violate laws.
  • Use automated means to access the Services in a way that meaningfully disrupts or harms them.

Additional license terms may apply to specific tools, SDKs, or releases and will be provided with those items.

6) “Powered by Crash BASIC” Attribution

Crash BASIC outputs or runtimes may include a “Powered by Crash BASIC” notice or splash screen depending on your plan:

  • Free tier: Not for commercial use
  • Indie tier: Splash screen required
  • Studio tier: Splash screen optional or removable

You agree to comply with the requirements of your selected plan.

7) Content Rules (Important)

7.1 Prohibited Content

You may not use the Services to create, upload, distribute, or promote content that:

  • Is Adults Only / explicit sexual content or pornography.
  • Exploits or sexualizes minors (zero tolerance).
  • Contains hate, harassment, threats, or encourages violence.
  • Promotes self-harm or dangerous wrongdoing.

8) Crash BASIC Arcade (Community & Sharing)

Crash BASIC Arcade is a place to share creations and discover projects made with Crash BASIC.

Unless we explicitly say otherwise:

  • Arcade is not a marketplace. Users may not sell products, sell access, or run paid transactions through Arcade features.
  • You may share links to your own external pages, but you must not use Arcade primarily as an advertising or spam channel.
  • You must follow all content rules in Section 7 and any posted policies (such as Community Guidelines and Acceptable Use Policy).

We may moderate, feature, de-list, or remove submissions at our discretion.

9) Removed (N/A)

10) User Content and Permissions

If you upload or submit content (“User Content”), you retain ownership of what you create as between you and Crash BASIC, but you grant Crash BASIC a license to host, store, reproduce, display, and distribute that User Content solely for operating, promoting, and improving the Services (for example: showing your game page, thumbnails, and previews).

This license is:

  • Worldwide, non-exclusive, royalty-free,
  • For as long as your User Content is on the Services (and for a reasonable time afterward for backups and legal compliance).

You represent that you have the rights necessary to upload your User Content and that it does not violate these Terms.

11) Intellectual Property

The Services, including the Crash BASIC name, logos, branding, software, documentation, and site content (excluding User Content), are owned by Crash BASIC and protected by intellectual property laws.

You may not use our trademarks (including “Crash BASIC,” “Crash-tan,” or related marks) in a way that suggests endorsement or affiliation without permission.

12) Third-Party Services

The Services may integrate with or link to third-party services (payments, analytics, hosting, social platforms). We are not responsible for third-party services, and your use of them is governed by their terms.

13) Acceptable Use (No Abuse)

You may not:

  • Attempt to disrupt, overload, scrape, or harm the Services.
  • Bypass access controls or attempt unauthorized access.
  • Upload malware or attempt to exploit vulnerabilities.
  • Use automated tools to mass-download content without permission.

We may throttle, block, or suspend abusive traffic or accounts.

14) DMCA / Copyright Complaints

If you believe content on the Services infringes your copyright, you may send a notice with:

  • Your contact info,
  • Identification of the copyrighted work,
  • Identification of the allegedly infringing material and where it appears,
  • A good-faith statement,
  • A statement under penalty of perjury that the info is accurate and you are authorized to act,
  • Your physical or electronic signature.

We may remove content and, where appropriate, terminate repeat infringers.

(Contact details are provided in Section 18.)

15) Termination

You may stop using the Services at any time.

We may suspend or terminate your access if:

  • You violate these Terms,
  • Your use creates risk or legal exposure,
  • We are required to do so by law.

Termination may result in loss of access to content or features. We are not liable for such loss to the extent permitted by law.

16) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee uninterrupted or error-free operation.

17) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRASH BASIC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO CRASH BASIC FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR $100 IF YOU PAID NOTHING).

Some jurisdictions do not allow certain limitations—those limitations apply only to the extent allowed.

18) Governing Law and Venue

These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles.

Unless prohibited by law, you agree that any dispute will be brought in the state or federal courts located in Tennessee, and you consent to their jurisdiction.
